Hazardous Road Accidents
Involved in an Accident Due to Hazardous Road Conditions?
Hazardous road accidents have many causes. Bad road design and poor maintenance is a factor in hazardous road accidents. Some examples of bad road design may include lack of guard rails, lack of sidewalks or crosswalks, lack of shoulders, inadequate signage, and baffling-marked lane lines. Examples of poorly maintained roads include inadequate paving, potholes, and overgrown trees and shrubs that hide signs and block the right of way. Lastly, driving recklessly in bad weather can cause hazardous road conditions and accidents.
Frequently, the driver is blamed for the collision but many times bad road design or lack of maintenance caused the collision. The burden of proof relies on the victim’s lawyer who must prove the roadway was dangerous; the municipality or governmental agency maintaining the road knew about the defects but ignored the situation; the victim’s injury was caused by the hazardous road; and the municipality or government agency could’ve fixed the problem for reasonable costs.
